The choice to participate in any program provided by Kitsilano Yacht Club, including any such program where the services, staff, or equipment of such program are provided by agents of the Kitsilano Yacht Club, is made freely and with understanding of the associated benefits, risks, and responsibilities.The activities offered at Kitsilano Yacht Club, including those where services, staff, and/or equipment are provided by agents of the Kitsilano Yacht Club, are designed to pose appropriate challenges to participants. The enjoyment and educational benefit derived from outdoor activities is, in part, a result of risks inherent in these activities. The benefits of participation include developing self-confidence, leadership, teamwork and interpersonal skills, exposure to outdoor recreation activities, and nature education. While Kitsilano Yacht Club strives to manage risk, it is neither possible nor desirable to eliminate all physical risk. In consideration of allowing the Participant to participate in any Kitsilano Yacht Club program, event, or activity, including those where services, staff, and/or equipment are provided by agents retained by the Kitsilano Yacht Club, I understand that: • Kitsilano Yacht Club offers outdoor activities with services, staff, and/or equipment provided by Kitsilano Yacht Club or by its agents, which include but are not limited to: instructional courses in sailing, stand up paddle boarding, kayaking, cruising, and other related activities. • Outdoor activities include inherent risks that may be different or greater than those risks normally assumed at home, work, or school. These risks include but are not limited to: slipping, insect or animal bites, immersion in cold water, hypothermia (cold exposure), hyperthermia (heat exposure), uneven terrain, unpredictability of weather and ocean conditions and the consequences therefrom, psychological and physical reaction to extreme natural forces and conditions, collision with exposed or unexposed hazards including vessels, loss or damage of personal property, injury, permanent disability, and death. • Communication and emergency response times may be significantly longer than in urban settings. • I may contact Kitsilano Yacht Club if I have questions about the risks described above or pertaining to any other aspect of the program. I agree that participating in Kitsilano Yacht Club programs with services, staff, and/or equipment provided by the Club or its agents requires the Participant to: 1. Share the responsibility for the safety of their self and others during all activities; 2. Follow all instructions and directions of instructors and guides and of Kitsilano Yacht Club staff and rules, failure to do any of which may result in removal from the program; and 3. Assume all the above risks and accept responsibility and costs for all damages and loss resulting from their participation, including any evacuation costs. I, as the Participant or Guardian of the Participant, am not relying on any oral, written or visual representation or statement by Kitsilano Yacht Club. I, as the Participant or Guardian of the Participant, in consideration of being allowed to participate in the activities of the Kitsilano Yacht Club, agree to absolutely waive, release and discharge forever, and save harmless and keep indemnified the Kitsilano Yacht Club, and its agents, officials, directors, executives, servants, and representatives, from all claims, actions, demands, costs and expenses of any kind in respect to death, personal injury, or loss or damage to property, however caused, including caused by the negligence of Kitsilano Yacht Club and its respective organizers, agents, directors, officials, executives, servants and representatives. Without expectation of compensation or other remuneration, now or in the future, I hereby give my consent to the Kitsilano Yacht Club, its affiliates and agents, to use my image and likeness and/or any interview statements from me in its publications, advertising or other media activities, including the Internet. This consent is given in perpetuity, and does not require prior approval by me. This consent includes, but is not limited to: Permission to interview, film, photograph, tape, or otherwise make a video reproduction of me and/or record my voice; Permission to use my name; and Permission to use quotes from the interview(s) (or excerpts of such quotes), the film, photograph(s), tape(s) or reproduction(s) of me, and/or recording of my voice, in part or in whole, in its publications, in newspapers, magazines and other print media, on television, radio and electronic media, including the Internet, in media and/or in mailings for Kitsilano Yacht Club purposes. KYC Refund and Cancellation Policy • 14+ Days Cancellation: 100% refund of the registration cost, less an $75 administrative fee and any applicable transaction platform processing fees, if a cancellation is received at least 14 days prior to the start of the class. • 8–14 Days Cancellation: For cancellations received between 8 and 14 days before the class starts, you will receive a refund equal to 50% of the registration cost, less any transaction platform processing fees. However, if 50% of the registration cost would result in KYC retaining less than $75 as an administrative fee, the refund will be adjusted so that KYC retains a minimum of $75. • Late Cancellations: No refund will be given for cancellations received 7 days or less prior to the start of the class, or once classes have begun, unless extenuating circumstances warrant an exception. Each case will be evaluated individually. • Elective Absences: No pro-rated refunds or partial pricing options are available for any elective absences. • Exceptions for Illness or Injury: Exceptions for illness or injury may be granted at the discretion of the Program Director, with supporting documentation. If granted, the refund amount will be determined by the Program Director, taking into account the timing of the cancellation and other relevant factors. • Course Cancellation by KYC: In the event that a course is cancelled by KYC due to insufficient enrolment or other unforeseen or operational circumstances, KYC will notify you as early as possible and offer either a full refund, course credit, or the option to transfer to another KYC course. No administrative fee will be charged when a course is cancelled by KYC. • Discount Eligibility: Eligible discounts must be applied at the time of purchase. No reimbursements or partial refunds will be provided for discounts that were not utilized. • Policy Updates: This policy is subject to change. Any revisions will apply only to purchases made after the effective revision date. Please refer to your purchase receipt for the refund policy applicable to your transaction.
